Selling property in Algeria from abroad: the steps and the pitfalls

Selling a flat in Algiers while living in Brussels looks simpler than buying: the buyer is often already on site, and the price is quickly agreed. Yet when a sale falls through, it is most often before the signing, over issues the seller had not anticipated from Europe.

First check: the title
A serious buyer, and above all their notary, will check that you really are the owner according to the land registry. In Algeria, it is registration in the land register that actually transfers ownership. A deed signed but never registered, a property still in the name of a deceased parent, a missing title: all of these must be resolved before putting the property on the market.

Signing remotely: a specific, limited power of attorney for the sale
If you cannot attend the notary's office, a special power of attorney for the sale is essential. It identifies the property precisely, sets a minimum price, lists the authorised acts, and provides that the price is paid directly into your account or to the notary, never to the agent. The price: through the banking system, never in cash
The price is paid through the banking system. Cash payment has no place in property transactions any more, and declaring a price below the real one is tax fraud, all the riskier now that the tax administration relies on a price reference scale.
Capital gains: calculate them before setting your price
The sale may generate a capital gain subject to income tax (IRG). The rules have changed with successive finance laws: rate, relief based on how long the property was held, and exemptions in certain cases, notably for some sales made to end a joint inheritance. The amount is calculated case by case, and it is better to know it before setting the price. The sale may also have tax consequences in your country of residence: a point to review with your tax adviser.
After the sale: where does the money go?
This is the question sellers ask last, and should ask first. Transferring the sale price to an account in Europe is not automatic: it is governed by foreign exchange regulations and depends in particular on the origin of the funds used for the purchase.
